1. Acceptance of Terms
Welcome to French Riviera Tropézienne Bakery, operated by La Tropézienne Factory LLC. By accessing this website, submitting a form, placing an order, or otherwise using our services, you agree to be bound by these Terms of Service. If you do not agree with them, please do not use this website or our services. We may update these Terms from time to time; the revised version will be posted on this page with a new effective date, and your continued use of our website or services after that date means you accept the updated Terms.
2. Description of Services
French Riviera Tropézienne Bakery is a French bakery and pâtisserie operating three boutiques in Henderson and Las Vegas, Nevada. We bake and sell viennoiseries, breads, pastries, desserts, sandwiches and coffee; we make celebration and custom cakes to order; and we supply catering platters for events. This website presents our menu, our boutiques and our contact details, allows you to send us a message, and links to our ordering and catering partners. Menu items, prices and hours may change, and items are sold subject to availability — we bake in small batches and sell until we run out.
3. Orders and Payment
All orders, whether placed in one of our boutiques, by telephone, or through an online ordering partner, are subject to availability and acceptance by us. Prices are shown in US dollars and may change without notice; the price that applies is the one in effect when your order is accepted. Payment must be completed before an order is confirmed and released. Custom cakes and catering orders require advance notice — normally 48 hours, or 72 hours for a custom design — and may require a deposit, which is applied to the final price.
Because we sell fresh food, all sales are final unless a problem with a product is reported to us immediately upon receipt, in which case we will replace it or refund it. Please respect the pickup time you agreed with us; we cannot guarantee the condition of a product left uncollected. Where delivery is carried out by a third-party service, that service is responsible for the delivery itself and we are not liable for delays caused by it.
4. Intellectual Property
All content on this website — including the name French Riviera Tropézienne Bakery, our logo, photographs, videos, recipes, menu descriptions, page copy, layout and design — is owned by La Tropézienne Factory LLC or used with permission, and is protected by copyright, trademark and other laws. You may view, download and print pages of this site for your own personal, non-commercial use. You may not copy, republish, sell, or use our content, images or branding for commercial purposes, or in any way that suggests an association or endorsement, without our prior written permission. You also agree not to misuse this website, attempt unauthorised access to it, or use it for any unlawful purpose.
5. Limitation of Liability
Our website and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, French Riviera Tropézienne Bakery and La Tropézienne Factory LLC will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of this website, our products or our services. Our total liability in connection with any order is limited to the amount you paid for that order.
Allergens. Our products are made in kitchens that handle wheat, eggs, dairy, nuts, peanuts, soy, sesame and fish. We cannot guarantee that any item is free of a given allergen, and we cannot accept liability for allergic reactions. If you have a food allergy or intolerance, please speak to us before ordering.
6. Governing Law
These Terms of Service, and any dispute arising out of or relating to them, this website, or our products and services, are governed by the laws of the State of Nevada, without regard to its conflict-of-law rules. You agree that the state and federal courts located in Clark County, Nevada have exclusive jurisdiction over any such dispute.
7. SMS Messaging Terms
Program description. If you opt in, French Riviera Tropézienne Bakery will send you text messages relating to order updates, appointment reminders, and promotional offers from French Riviera Tropézienne Bakery. You opt in by checking the SMS consent box on our contact form, or by giving us your mobile number and agreeing to receive texts in one of our boutiques. The box is unchecked by default and you can submit our form without checking it.
Frequency: Message frequency varies.
Cost: Message and data rates may apply.
Opt-out: You can opt out at any time by replying STOP to any message we send you. You will receive one final message confirming that you have been unsubscribed, and we will send you no further texts.
Help: For help, reply HELP to any of our messages, or contact us at contact@latropezienefactory.com.
Not a condition of purchase: Consent to receive text messages is not a condition of any purchase. You can order from us, and we will serve you exactly the same, whether or not you opt in.
Carrier liability: Carriers are not liable for delayed or undelivered messages. Delivery of text messages depends on your mobile carrier's network and is not guaranteed.
Supported carriers and changes of number: The program is available on major US carriers. Please tell us if your mobile number changes so that we do not message someone else.
How we handle the mobile information you give us — including the fact that it is never shared with third parties or affiliates for marketing or promotional purposes — is set out in our Privacy Policy.
